Ken Bigelow

A six-year veteran of WestLB when he was promoted to CIO of the New York office in November 2004, Bigelow unknowingly inherited the onerous data retrieval process in Claudia Quinby's sex discrimination lawsuit against the bank. He helped in the bank's effort to dig up old data and e-mail for WestLB's accuser. The company lawyer has prohibited him from talking about the case.


Michael Waxenberg

Waxenberg, who worked in WestLB's information-technology department, "dedicated large portions of his work hours" to retrieving data for the Quinby case, he said in court papers. That included standing before a judge a year ago to defend how WestLB conducted e-mail searches.


Claudia Quinby

Quinby sued WestLB in 2004 for sex discrimination and retaliatory termination in U.S. District Court in New York. She was recruited for WestLB from Credit Lyonnais, according to court filings. WestLB admits terminating her, rehiring her and then terminating her again, but denies her charges.


John Parker

WestLB Securities Inc.
Quinby, in her lawsuit against WestLB, alleges Parker wrote and allowed traders to write insulting e-mails about her, among other charges, when he supervised her at the bank. Parker told Baseline he has no comment on the case. He left WestLB in March 2005, according to court papers. He is now the CEO of the New York office of Global Investment Holdings.

Stuart Hanley
Electronic Evidence Consultant, Kroll Ontrack
Hanley has helped WestLB retrieve electronic evidence for several lawsuits and investigations, including the Quinby case. He said in court papers that Kroll has set the "industry standard" for electronic discovery.


Ariel Perez
Account Manager
Hewlett-Packard
Perez ran information technology for WestLB's New York office until mid-2003, then joined HP when the bank outsourced technology operations to HP in January 2005, Bigelow said in his deposition.


Dawn Groman Darringer

McDermott, Will & Emery
Groman Darringer is one of several attorneys representing WestLB. She sparred with Peratis and Malalis in numerous hearings, and accused them in court of "mak[ing] everything a fight." She told the court that WestLB has spent "enormous time and money" on electronic discovery.


Kevin Faulkner
Forensic Examiner
Faulkner, now a consultant at Protiviti, was an expert witness for the plaintiff. He challenged Waxenberg from WestLB's technology department on the bank's reliance on backup tapes to produce e-mail evidence. He claimed WestLB wasted time and money. However, the court found otherwise, saying the tapes are the most complete source of evidence.
